Information We Collect

When you interact with our website or other online services that link to this Privacy Notice, communicate with us, or otherwise engage with Sun Belle, we may collect information that directly identifies you, information that relates to your business or employment relationship with us, and information about your use of our online services. The categories of information we collect may vary depending on your interaction with us.

For purposes of this Privacy Notice, “personal information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked with an individual or household. This may include information collected directly from you, automatically through technology, or from our service providers and business partners. It does not include information excluded from that definition under applicable law, such as certain publicly available, aggregated, or de-identified information.

Information You Provide to Us

We collect information you provide directly to us, such as when you fill out a form, subscribe to communications, contact us, request information, report a product matter, apply for opportunities, participate in a promotion or survey we offer, or otherwise communicate with us. The types of personal information we may collect include your name, company name, business contact information, email address, mailing address, phone number, application or employment-related information, the type of inquiry, and any other information you choose to provide.

Depending on the reason for your inquiry or interaction, we may also collect information about a product, retailer, store, purchase location or date, lot or package, business or employment relationship, and your communications with us. Please do not provide Social Security numbers, government identification numbers, account credentials, precise geolocation, health information, biometric information, financial account information, or other sensitive personal information through the public website contact form or another free-text field unless requested for the relevant purpose. The recruiting or employment process may request additional information as described in the notices provided in that context.

Information We Collect Automatically When You Interact With Us

When you access our website, we automatically collect certain information, including:

  • Device and Usage Information: We collect information about how you access and use our website, including information about the device and network you use, such as your IP address, operating system, browser type, and device identifiers. We also collect information about your activity on the website, such as access times, pages viewed, links clicked, the page you visited before navigating to the website, cookie and consent choices, and general location derived from your IP address. We do not intentionally collect precise geolocation through the website.
  • Information Collected by Cookies and Similar Technologies: Cookies, scripts, tags, pixels, local storage, and similar technologies help us operate and secure the website, remember preferences, provide and translate features, understand how visitors use the website, measure performance, and display embedded content. These technologies may collect information such as your IP address, browser and device information, pages viewed, links clicked, referring pages, general location, and interactions with forms or embedded media. Additional information about the technologies used on the website and the choices available to you appears in the Your Choices section below.

Information We Receive from Other Sources

We may receive information from Frutura-related entities, website and form providers, analytics providers, recruiting platforms or sources, customers, retailers, suppliers, growers, logistics providers, professional advisors, and other third parties when needed to operate the website, respond to an inquiry, address a product quality or safety matter, administer recruiting or employment relationships, protect our interests, or manage a business relationship.

California Notice at Collection

For California residents, this section also serves as our Notice at Collection. It describes the categories of personal information we collect through the website and related interactions, including recruiting and employment interactions covered by this Notice, the purposes for which we use it, whether it may be sold or shared as those terms are defined by California law, and the criteria we use to determine how long it is retained. We do not sell personal information for money. If a disclosure of online information through Google Analytics or YouTube is treated as a sale or sharing, you may opt out as described in the Your Choices section below.

Identifiers and Personal Information Described in California Civil Code Section 1798.80(e): We collect names, email addresses, telephone numbers, mailing addresses when provided, IP addresses, cookie or consent identifiers, and device identifiers to operate and secure the website, provide forms and features, respond to inquiries, communicate, manage business, recruiting, and employment relationships, and comply with law. Contact information is not sold or shared for cross-context behavioral advertising. Online identifiers may be disclosed through Google Analytics or YouTube as described below. We retain this information for the time needed to respond to an inquiry, evaluate an application, or maintain the relationship and thereafter as needed for legal, security, human-resources, recordkeeping, product-quality, or dispute purposes. Cookie and device identifiers are retained according to the applicable cookie lifespan or technology setting.

Commercial Information; Professional or Employment-Related Information; and Communications: We collect employer or organization information, job title or role, business contact information, application materials and other recruiting or employment-related information, product and purchase details you provide, inquiry information, and communications to respond to consumer and business inquiries, administer recruiting and employment relationships, investigate product quality or safety matters, support recalls or corrective actions, manage customer, retailer, supplier, vendor, grower, logistics, and other business relationships, and maintain records. We do not sell or share these categories for cross-context behavioral advertising. We retain them for the time needed to address the inquiry, application, employment, or business relationship and thereafter as needed for employment-related, product-quality, safety, recall, contractual, legal, audit, tax, recordkeeping, or dispute purposes.

Internet or Other Electronic Network Activity Information; Geolocation Data; and Preferences: We collect browser, device, page-view, click, log, cookie, consent, embedded-media interaction, general location, language, and privacy-preference information to operate, secure, troubleshoot, and translate the website, remember and document choices, measure traffic and performance, conduct analytics, and display embedded content. Online identifiers, internet activity, approximate location, and interaction information may be disclosed to Google through Google Analytics or YouTube and may be treated as a sale or sharing under some laws. We retain this information according to the applicable cookie lifespan, consent setting, vendor configuration, or security and operational need. We may retain consent and compliance records longer as needed to document your choices.

Sensitive Personal Information: We do not ask you to provide sensitive personal information through the public website contact form or related consumer or business communications. If the recruiting or employment process requests sensitive personal information, the purpose and handling of that information will be described in any additional notice presented in that context. If we receive sensitive personal information incidentally because you include it in a message, we use it only as reasonably necessary to respond to your communication, administer the applicable recruiting or employment process, protect safety or legal rights, or comply with law. We do not sell or share sensitive personal information and retain it only for as long as reasonably necessary for the permitted purpose, legal compliance, security, or dispute resolution.

  • Evaluate or carry out a merger, financing, acquisition, restructuring, sale, bankruptcy, or other business transaction; and

We may also use device and usage information to compile statistics, evaluate trends, troubleshoot issues, improve our website and communications, and support fraud prevention, security assessments, and other legitimate business purposes. We may create aggregated or de-identified information and use or disclose it for lawful purposes. When we maintain information in de-identified form, we do not attempt to reidentify it except as permitted by law to test whether our de-identification processes are effective.

Disclosure of Your Information

We may disclose the categories of personal information described above as follows, depending on the purpose and the recipient:

  • To Frutura-related entities and other affiliated companies, as necessary to provide shared business, technology, security, compliance, legal, or administrative services for the purposes described in this Privacy Notice;
  • To vendors, service providers, contractors, professional advisors, logistics partners, technology providers, and consultants that support our business, including website hosting and development, consent management, online forms, font and content delivery, translation, information technology, cybersecurity, communications, analytics, recruiting and human resources administration, consumer and business relationship management, records management, audit, and similar functions;
  • To Google or YouTube, which may receive online identifiers, internet or network activity, approximate location, and related information through Google Analytics or embedded YouTube content. Google or YouTube may collect information about your activity over time and across websites or online services and may use that information for their own purposes under their privacy terms;
  • To customers, retailers, suppliers, growers, logistics providers, and other business partners when reasonably necessary to respond to an inquiry, investigate a product quality or safety matter, coordinate a recall or corrective action, or manage a business relationship;
  • To fulfill the purpose for which you provide the information, for another purpose disclosed when you provide it, or with your consent and at your direction;
  • To professional advisors and insurers for legal, accounting, tax, audit, insurance, risk-management, and similar services;
  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, financing, acquisition, bankruptcy, or other sale or transfer of some or all of Sun Belle’s assets or business;
  • To comply with a court order, law, legal process, government or regulatory request, food-safety obligation, investigation, recall, or other legal requirement; and
  • If we believe disclosure is necessary to protect the rights, property, safety, or security of Sun Belle, our affiliates, our visitors, the public, or others, or to prevent fraud, misuse, or other unlawful activity.

We do not sell personal information for money. Depending on how applicable privacy laws define “sale,” “sharing,” or targeted advertising, disclosures of online identifiers, internet or network activity, approximate location, and interaction information to Google through Google Analytics or YouTube may be considered a sale or sharing of personal information. Where required, we provide a way for you to opt out of these activities as described in the Your Choices section below.

We may also disclose aggregated or de-identified information that cannot reasonably be used to identify you. If Sun Belle discloses personal information to a successor in connection with a business transaction, we will seek to require the recipient to honor the commitments described in this Privacy Notice or provide notice of any material changes where required by law.

Your Choices

Communication Preferences

If you receive promotional emails from Sun Belle, you may opt out by following the instructions in those communications or by contacting us using the information in the Contact Information section below. If you opt out, we may still send non-promotional communications about an inquiry, application, business or employment relationship, product matter, security issue, legal obligation, or other operational matter.

Analytics, Advertising, and Similar Technologies

We use the third-party services and technologies described below to operate website features, understand how visitors use the website, and display content. These services may collect device and usage information as described above.

CookieYes: CookieYes displays the cookie banner, records your cookie choices, and uses a necessary cookie or similar technology to remember those choices.

Cognito Forms: Cognito Forms provides the website’s contact form. Its external script loads when the contact form is displayed, before you make a CookieYes choice, and may receive your IP address, browser or device information, and related technical information. Cognito Forms also receives the information you submit through the form.

Adobe Typekit and TranslatePress: The website obtains fonts from Adobe’s content-delivery network and uses TranslatePress to provide multilingual content. Adobe may receive your IP address, browser or device information, and related technical information when the fonts load.

Google Analytics 4: We use Google Analytics 4 to measure website traffic and understand how visitors use the website. Google Analytics is enabled only after you opt in to analytics through CookieYes and may collect online identifiers, browser and device information, website activity, and approximate location.

YouTube: The Sustainability page contains an embedded YouTube video. When the embed or video loads or is played, Google or YouTube may receive online identifiers, browser or device information, website and video interaction information, and approximate location, and may use that information under their own privacy terms.

Instagram Feed: The website displays Instagram content through a server-side, cached feed. Under the current configuration, the feed is not intended to transmit visitor information to Meta.

Paylocity: The Careers page displays job listings through an embedded Paylocity service. When the listings load, Paylocity may receive your IP address, browser or device information, and related technical or interaction information. Information submitted in connection with a job application may also be processed through Paylocity and is covered by this Privacy Notice to the extent Sun Belle receives or controls it. Additional notices presented during the recruiting process and Paylocity’s own privacy practices may also apply.

For more information about how Google uses information from websites or apps that use its services, review Google’s privacy information.

Cookie Management

Most web browsers automatically accept cookies. You can usually adjust your browser settings to remove or reject cookies. You may also accept or reject nonessential technologies through CookieYes and may reopen Cookie Settings to change your choices. Your choice generally applies to the browser and device on which you make it.

Clearing cookies or using another browser or device may require you to make the choice again. Rejecting or blocking a technology may affect the availability or operation of the related feature. When you reject the applicable technologies or send a recognized opt-out preference signal, Google Analytics does not run and the YouTube embed does not transmit visitor information. To opt out of disclosures that may be considered a sale, sharing, or targeted advertising, use Cookie Settings or a legally recognized opt-out preference signal.

Do-Not-Track Browser Signals

Your browser and other mechanisms may permit you to send do-not-track or similar signals. Because there is no common standard for traditional “Do Not Track” signals, the website does not respond to them. CookieYes is configured so that the website honors Global Privacy Control and other legally recognized universal opt-out preference signals as requests to opt out of sale, sharing, or targeted advertising for the browser or device that sends the signal, as required by applicable law.

Social Media and Third-Party Links

Our website may include links to third-party websites, social-media pages, recruiting tools, videos, plug-ins, or interactive features. If you interact with those services or follow links to external websites, the third party may collect information from you or your browser or device under its own privacy notice. Sun Belle does not control the privacy or security practices of third parties acting independently, and we encourage you to review their privacy notices before providing information or using their services.

Sale, Sharing, and Targeted Advertising

Sun Belle does not sell personal information for money. Google Analytics and YouTube may receive online identifiers, internet or network activity, approximate location, and website or video interaction information and may use that information for their own purposes. Depending on applicable law and how the services are configured, those disclosures may be considered a sale, sharing, or targeted advertising. You may opt out through Cookie Settings or a legally recognized universal opt-out preference signal such as Global Privacy Control. We do not require identity verification for a browser- or device-based opt-out. We do not sell sensitive personal information.

Your Privacy Rights

Residents of California, Maryland, Texas, and other states with applicable comprehensive privacy laws may have rights regarding their personal information, subject to the limitations, exceptions, and verification requirements in those laws. Whether a right applies may depend on the state and the context in which the information was collected, including whether it was collected in an applicant or employment context.

Depending on where you live and how you interact with us, these rights may include the right to confirm whether we process your personal information; know or access the information we have collected about you; request a copy in a portable format; delete certain information; correct inaccurate information; opt out of sale, sharing, targeted advertising, or qualifying profiling; limit certain uses or disclosures of sensitive personal information; withdraw consent where processing is based on consent; appeal a decision we make regarding a privacy request; and exercise your rights without unlawful discrimination or retaliation.

We will honor privacy rights requests as required by applicable law. We may ask you to provide information reasonably necessary to verify your identity and authority to make the request. Authorized agents may submit requests where permitted by law, but we may require proof of authorization and may ask you to verify your identity directly with us.

To exercise a privacy right other than a cookie-based opt-out, use one of the following methods:

  • Online: Submit the Sun Belle contact form at https://www.sun-belle.com/about/#contact and state “Privacy Request” in the message.
  • Email: marketing@sun-belle.com, with “Privacy Request” in the subject line.
  • Mail: Sun Belle, LLC, Attn: Consumer Relations, 3810 Rose Street, Schiller Park, Illinois 60176.
  • Telephone: 708-343-4545

Once we receive your request, we may request information sufficient to confirm your identity and authority. We may deny or limit a request as permitted by law, including where we cannot verify the request, an exception applies, fulfilling the request would interfere with another person’s rights, or we must retain the information. Where required, we will respond within 45 days and may extend that period as permitted by law.

If we deny a request in whole or in part and applicable law provides a right to appeal, you may appeal by submitting the contact form or emailing marketing@sun-belle.com with “Privacy Appeal” in the subject line or message. We will respond to the appeal within the time required by applicable law and, if we deny the appeal, provide information about how to contact the appropriate attorney general or regulatory authority where required.

In addition to the rights described above, Maryland residents may request a list of the categories of third parties to which Sun Belle has disclosed their personal data or, if Sun Belle does not maintain that information on a consumer-specific basis, the categories of third parties to which Sun Belle has disclosed any consumer’s personal data.

We will not unlawfully discriminate or retaliate against you for exercising privacy rights, although some services or features may depend on our ability to process the relevant information.

Children’s Privacy

Our website is intended for a general audience and is not directed to children under 13. Consistent with the Children’s Online Privacy Protection Act (COPPA), we do not knowingly collect personal information from children under 13 through the website. If a parent or guardian believes that a child under 13 has provided personal information to us, they may contact us using the information below, and we will take steps to delete the information as required by law. Consistent with the California Consumer Privacy Act (CCPA), we do not knowingly sell or share the personal information of individuals under 16. Consistent with applicable state privacy laws, we also do not sell personal information or process it for targeted advertising when we know or should know that the individual is under 18.

Additional Information for California Residents

During the preceding 12 months, the categories of personal information we collected through the website and related interactions were identifiers; personal information described in California Civil Code Section 1798.80(e); commercial information; internet or other electronic network activity information; geolocation data; and professional or employment-related information, including information collected in business-contact, applicant, and employment contexts. The examples, sources, purposes, and retention criteria for those categories are described above.

We disclosed those categories for business purposes to service providers and contractors that support website hosting and development, consent management, online forms, font and content delivery, translation, information technology, cybersecurity, communications, analytics, recruiting and human resources administration, consumer and business relationship management, records management, audit, legal, and similar functions; to Frutura and affiliated companies that provide shared services or support operations; to customers, retailers, suppliers, growers, logistics providers, and other business partners when needed to respond to an inquiry or product matter; and to professional advisors, authorities, insurers, and transaction participants as described above.

We did not sell personal information for money. Before the current website launched, the prior Sun Belle website did not use Google Analytics, YouTube embeds, or other analytics, advertising, or social-media technologies that received visitor information. The current website uses Google Analytics and YouTube as described above. Those services may receive identifiers, internet or other electronic network activity information, and geolocation data for analytics, performance measurement, embedded-media functionality, and their own purposes, and California law may treat those disclosures as a sale or sharing. We did not sell or share the other categories described above. You may opt out as described above.

We do not use or disclose sensitive personal information for purposes that require a right to limit under California law. We do not have actual knowledge that we sell or share personal information of consumers under 16. If Sun Belle uses covered automated decision-making technology in a recruiting or employment context, any applicable notices and rights will be addressed as required by law and in any additional notice provided in that context.

California residents may exercise the rights to know, access, correct, delete, opt out of sale or sharing, limit certain uses or disclosures of sensitive personal information, and receive equal treatment, subject to applicable exceptions. Use the request methods described above. The California Notice at Collection appears in the Information We Collect section.

Data Security

The security and confidentiality of your personal information are important to us. We maintain reasonable administrative, technical, and physical safeguards designed to protect personal information from accidental or unlawful destruction, loss, alteration, unauthorized disclosure, or access. We select and review safeguards based on the nature of the information and the risks of processing.

No internet transmission or storage system can be guaranteed to be completely secure. We review and update our safeguards as appropriate based on the nature of the information and the risks of processing. We encourage you to use care when transmitting information online and not to submit sensitive personal information through an unsecured channel or free-text field.

Data Retention

We retain personal information for as long as reasonably necessary and proportionate to fulfill the purposes described in this Privacy Notice, comply with legal and recordkeeping obligations, resolve disputes, maintain security, and support legitimate business needs.

Retention periods vary depending on the type and sensitivity of the information; the purpose for which it was collected; the duration of the inquiry, application, employment, business relationship, or product matter; applicable legal, employment-related, food-safety, tax, accounting, audit, regulatory, and contractual requirements; security needs; and potential claims. We may retain information longer when it is subject to a legal hold, investigation, recall, unresolved request or dispute, or another legal obligation. We apply the category-level retention criteria described in the California Notice at Collection above.

Privacy Notice Changes

We may update this Privacy Notice from time to time to reflect changes in our practices, technologies, legal requirements, or business operations. When we do, we will revise the date at the top of this Privacy Notice and, if the change is significant enough that applicable law requires additional notice or consent, we will provide that notice or obtain that consent before applying the change to previously collected information. We encourage you to review this Privacy Notice regularly.
